A woman who worked at a Coral Gables car dealership for 10 years received a $150,000 pretrial settlement after alleging she was denied a promotion and was later constructively discharged in violation of Title VII of the Civil Rights of 1964 Act.
The Equal Employment Opportunity Commission asserted Abraham Chevrolet-Miami Inc. owners did not announce or post the open position internally or externally and didn't conduct a formal hiring process to fill a vacancy, which left the claimant unable to pursue a promotion. The position was filled by a male sales associate.
The EEOC alleged the claimant was told by management that the dealership "needed a man for the position" and later acknowledged the claimant was the most qualified person for the job.
