LEE CIRCUIT COURT

A passenger in a pickup truck received a $446,426 pretrial settlement for numerous abrasions and contusions to her torso, and cervical and lumbar injuries suffered when the truck was involved in a multivehicle collision. The woman also suffered from headaches and was diagnosed with postconcussion syndrome.

Ana Marrero, then a 58-year-old psychiatric nurse, claimed her injuries caused her to miss about one year of work while she treated conservatively with injections, physical therapy and painkillers.

Defense counsel noted Marrero did not undergo any surgery following the accident and contended she had some pre-existing degenerative changes in her spine.
