Apple fails in bid to delay import ban on Apple Watch models, still set to halt sales

(Reuters) — The US International Trade Commission (ITC) on Wednesday denied a motion by Apple to stop an import ban on some high-end Apple Watches from going into effect.

The Biden Administration still has a Dec. 25 deadline to determine whether to veto the ban for public policy reasons.

Apple had made a motion to the ITC to temporarily halt the order while the case is under appeal or in light of a potential government shutdown.

Masimo won an ITC patent case over technology that enables the blood oxygen feature on some of Apple's smartwatches.

Apple decided to halt sales of its Apple Watch Series 9 and Apple Watch Ultra 2 after the ITC granted medical device maker Masimo cease-and-desist and limited exclusion orders preventing the US tech giant from importing and selling the watches in the US.

Apple said it would remove the watches from its online stores by the afternoon of Dec. 21 and from physical stores by Dec. 24.
